ARTICLE 2- SUBJECT

The subject of this contract is to determine the rights and obligations of the parties in accordance with the Law No. 4077 on the Protection of Consumers and the Regulation on the Principles and Procedures of Distance Contracts regarding the sale and delivery of the product that the BUYER orders electronically from the SELLER's CHICLIFE DANİSMANLİK GIDA SAN VE TIC LTD STİ website, the qualities and sales price of which are specified below.

ARTICLE 4- GENERAL PROVISIONS
 
4.1- The BUYER declares that they have read and been informed about the essential qualities of the product subject to the contract, the sales price, and the method of payment, and have given the necessary confirmation electronically.
4.2- The product subject to the contract shall be delivered to the BUYER or the person/institution at the address indicated by the BUYER within the period specified in the preliminary information on the website, depending on the distance of the BUYER's residence, provided that it does not exceed the legal 3-day period.
4.3- If the product subject to the contract is to be delivered to a person/institution other than the BUYER, the SELLER cannot be held responsible for the non-acceptance of the delivery by the person/institution to whom it is to be delivered.
4.4- The SELLER is responsible for delivering the product subject to the contract in a solid, complete manner, in accordance with the specifications indicated in the order, and with any guarantee documents and user manuals if available.
4.5- For the delivery of the product subject to the contract, it is a condition that a signed copy of this contract has been delivered to the SELLER and the payment has been made with the payment method preferred by the BUYER. If the product price is not paid for any reason or is canceled in the bank records, the SELLER is deemed to be relieved of the obligation to deliver the product.
4.6- If the BUYER's credit card, after the delivery of the product, is used unlawfully or improperly by unauthorized persons due to no fault of the BUYER, and the relevant bank or financial institution does not pay the product price to the SELLER, it is mandatory that the product be sent back to the SELLER within 3 days, provided that it has been delivered to the BUYER. In this case, shipping costs are borne by the BUYER.
4.7- If the SELLER cannot deliver the product subject to the contract on time due to force majeure or extraordinary situations such as adverse weather conditions that hinder transportation, or interruption of transportation, the SELLER is obliged to inform the BUYER of the situation. In this case, the BUYER may exercise one of the rights to cancel the order, to replace the product subject to the contract with a similar one if available, and/or to postpone the delivery period until the impediment is removed. If the BUYER cancels the order, the amount paid will be refunded in cash and in full within 10 days.
4.8- Products sold with a guarantee certificate, whether defective or not, can be sent to the SELLER for necessary repairs within the terms of the warranty, in which case the shipping costs will be covered by the SELLER.

ARTICLE 5- RIGHT OF WITHDRAWAL

The BUYER has the right of withdrawal within 7 days from the delivery of the product subject to the contract to themselves or to the person/institution they indicated. To exercise the right of withdrawal, it is necessary to notify the SELLER by fax, email, or phone within this period, and the product must not have been used in accordance with the provisions of Article 6. In the event of exercising this right, it is mandatory to return the original invoice along with a copy of the cargo delivery report indicating that the product delivered to a third party or the BUYER has been sent back to the SELLER. The product price will be refunded to the BUYER within 7 days following the receipt of these documents. If the original invoice is not sent, VAT and any other legal obligations cannot be refunded. The shipping cost of the product returned due to the right of withdrawal will be covered by the SELLER.

ARTICLE 6- PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE USED

Products that cannot be returned due to their nature, single-use products, copyable software and programs, rapidly deteriorating or expired products cannot exercise the right of withdrawal. The use of the right of withdrawal for the following products is conditional upon the product's packaging being unopened, undamaged, and the product being unused.
